The rider of Miss Defy (K Watson) was charged for using his whip in an excessive manner for the length of the straight.

--He admitted the breach.
--Stipendiary Steward Mr N Goodwin showed the available films and informed the committee that Jockey Watson's actions were outside the guidelines. From the top of the straight till the 200 metre mark the horse had been struck a minimum of 15 times.
--Jockey Watson told the committee he regretted his actions. He was asked to ensure the horse was hit with the whip as he could be a lazy runner. He told the committee that he had been warned but not charged under this rule before.
--Mr Goodwin confirmed his record under the rule but believed it was not of a minor nature and a period of suspension was warranted.
--Jockey Watson told the committee he did not get many rides, his finances were not good, and he would be happy with a suspension.
--In suspending Jockey Watson from the completion of racing on Saturday 27 May until the completion of racing on Monday 5 June (3 C D riding days) the committee took account of Jockey Watson's record, and his admittance of the breach.
--He was told that it was an offence at the higher end of the scale and that his actions were well outside the guidelines. It could be argued, he was told, that his actions gave his horse an unfair advantage.
