An Information was lodged by Stipendiary Steward Mr JM Muirhead against Horseman Mr SJ Reid the Driver of Sno’s Big Boy alleging that Mr Reid drove his horse carelessly causing his own horse to break when improving into a gap with insufficient room between China Chinko and Avalon Sunset late in the run home.

Mr Reid admitted the breach and was present at the Hearing.

Rule 869(3)(b) states “No Horseman in any race shall drive carelessly.”

Mr Muirhead gave evidence that Mr Reid’s horse had suffered interference early in the race and that had caused it to break and that late in the race he was trying to manoeuver his horse into a gap.   This was close to the Finishing Post.   The gap was insufficient and Mr Reid’s horse broke.

Mr Muirhead demonstrated the incident by use of the video film and showed where Mr Reid had tried to move in between China Chinko and Avalon Sunset.   This was very late in the run home but Mr Muirhead said that the charge had been brought because Mr Reid could have injured his own horse and could have caused interference to other horses.

In response to a question by the Chairman, Mr Muirhead acknowledged that there were no horses behind Mr Reid’s horse and accordingly it was very unlikely that Mr Reid’s actions would have caused interference to any other horse.

Mr Reid was quite frank in acknowledging that he was guilty.   He confirmed that he had suffered interference early in the race but at the end of the race he was driving the favourite and he was trying to get his horse through a gap and into a better position.   He misjudged the size of the gap and his horse broke.

In respect to penalty Mr Muirhead referred to the guidelines but then recommended a fine in the range of $250.00 to $500.00.   He also referred to Mr Reid’s driving record which showed a charge of careless driving in January of 2008.

Mr Reid for his part accepted a fine but wanted the circumstances surrounding the incident to be taken into account.

Decision and penalty

--

In considering this matter the Committee looked at the film on a number of occasions.   We took into account that the incident was very late in the race and in our view approximately 10-12 metres before the Finishing Post.   We also took into account the fact that Mr Reid could not have caused interference to any horses behind him and further he did not cause injury to his own horse.

We realise that Mr Reid was doing his best for the Punters because he was driving the favourite and we gave him credit for his frankness in respect to the charge.   We are however mindful of the fact that Mr Reid was charged with careless driving in January 2008.

Taking all matters into account we view this charge at the bottom end of the scale and accordingly impose a fine of $300.00 on Mr Reid.
