CHARGES:

Following race 3 an Information was filed pursuant to rule 638 (1)(d).  The Informant Mr Williamson alleged that Mr Turner permitted his mount, KARIN’S KEEPER to shift in when not clear of IZABLUE near the 200 metres which had to be checked.

FACTS:

--

Mr Oatham demonstrated the video films which showed at a point near the 200 metres KARIN’S KEEPER (P Turner) racing in a 2 off position.  It was then evident on the films that Mr Turner moved in approximately one horse width and into the line of IZABLUE (J Gillies) when insufficiently clear of that runner.  As a result Mr Gillies received quite a severe check and nearly hit the running rail.  Mr Oatham said Mr Turner did not take any corrective action although THE HAGUE (R Cully) may have rolled in contributing to the interference.

SUBMISSION(s) ON PENALTY:

Mr Williamson said that as a result of the interference IZABLUE lost all chance.  He conceded however that THE HAGUE rolled in slightly and therefore he submitted a penalty at the lower end would be appropriate.

Mr Turner said he had commitments up to and including 28 July 2010.  He said he had little defence regarding the charge but believed the inward movement of THE HAGUE did contribute to the interference.

REASON(s):

--

The Committee considered all evidence and submissions before imposing a penalty.  Mitigating factors include Mr Turner’s guilty plea and the inward movement of THE HAGUE contributing to the interference.  However these must be considered along with the check received by IZABLUE which was mainly caused by Mr Turner moving in.  He was not the required distance clear and did not take any corrective action.

The Committee pointed out to Mr Turner that his breach today would normally warrant a five day suspension.  However because of the mitigating factors above we reduce this to four days.

PENALTY:

Accordingly we suspend Mr Turner from riding in races which is to start after racing on 28 July and conclude after racing on 5 August 2010 (4 days)
