On 23 August Chief Racecourse Inspector Mr J McKenzie filed an information pursuant to rule 304, alleging that Mr Trevor Stewart did, at the start of race 4 at the Racing Te Aroha race meeting on 23 August 2007, strike a horse, namely LADY EXPRESS in the head after it had been unloaded from the stalls.

On 23 August Chief Racecourse Inspector Mr J McKenzie filed an information pursuant to rule 304, alleging that Mr Trevor Stewart did, at the start of race 4 at the Racing Te Aroha race meeting on 23 August 2007, strike a horse, namely LADY EXPRESS in the head after it had been unloaded from the stalls.

Mr Stewart admitted the charge.

Mr McKenzie explained how LADY EXPRESS had become unsettled while in the starting stalls. Staff immediately went to assist horse and rider. The rider, A Webb, dismounted and LADY EXPRESS was taken out of the stalls. As she cleared the back of the stalls Mr Stewart, who had hold of the horse, was seen to strike it on the side of its head.

This action was clearly seen on Trackside video that was shown in evidence.

Mr McKenzie said that the reaction of Trackside viewers was immediate and that N Z T R and Racing Te Aroha had received many calls expressing their concern at what they had just seen.

Mr McKenzie emphasized that this behavior was reactive and not premeditated. He also stressed that it was unacceptable at any time or place.

--

To emphasize racing's attitude to this behavior he asked for a fine of $1000.

Mr Stewart had nothing to say during the hearing.

After taking all matters in to account including

--

1/ Mr Stewart's admission of the charge

--

2/ the likelihood that this behavior would involve an employment issue

--

The committee imposed a fine of $1000.
