Following the running of Race 7, NRM Sires' Stakes Series Final, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Trainer, Mr P F Kerr, alleging that Mr Kerr, as the trainer of ALTA SIROCCO in the race, "used pull blinds on that horse that malfunctioned as they could not be used for the correct purpose.

DECISION AND REASONS:
--Following the running of Race 7, NRM Sires' Stakes Series Final, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Trainer, Mr P F Kerr, alleging that Mr Kerr, as the trainer of ALTA SIROCCO in the race, "used pull blinds on that horse that malfunctioned as they could not be used for the correct purpose. The half blinds would not stay up at the start when the starter's assistant attempted to assist in placing them in the correct position."
--Mr Kerr was not present at the hearing of the information but had signed the Statement of Defendant endorsed on the information form acknowledging that he admitted the breach and that he did not wish to be present at the hearing.
--The words "recommended fine $200" had been written on the information form. Mr Escott confirmed that the proposed fine of $200 had been discussed with Mr Kerr prior to his signing the information form and he signed the form on that basis.
--The charge was found proved on the basis of Mr Kerr's admission of the breach and Mr Kerr was fined the sum of $200.
