| -- DECISION AND REASONS --Following Race 7 the rider of BALMUSE was charged under Rule 871(3) with making a celebratory gesture before the finish. Mr Bullard pleaded guilty to the charge. Mr McCutcheon stated that Mr Bullard started flourishing his whip well short of the finishing post. He said he stood up high and he was concerned in this case given the status of the race and the manner in which he flourished the whip. Mr Bullard said he was carried away in the emotion of the moment. --Penalty: --Mr McCutcheon said he wanted this practice stamped out and believed a fine of $1000 was appropriate. --Decision: --The committee considered all submissions, particularly the status of the race and the distance prior to the post that Mr Bullard commenced flourishing his whip. Accordingly we impose a fine of $750. --
