Following the running of race 4 an information was lodged by the Stipendiary Stewards under rule 870 (5) instigating an inquiry into Another Briteone (12) who finished fourth.

DECISION & REASON

--

Following the running of race 4 an information was lodged by the Stipendiary Stewards under rule 870 (5) instigating an inquiry into Another Briteone (12) who finished fourth. The information alleged that just prior to and over the finishing line that Another Briteone was not in its correct gate when lapped on by Tehora Mistletoe. Rule 870 (5) reads:

"Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee."

At the outset of the hearing Mr Lynn, a part owner/trainer and driver of Another Briteone, advised the Committee that he was representing the connections of the horse.

Following the showing of the video evidence Mr Lynn, on behalf of the connections of Another Briteone, accepted that the horse was in a break and lapped on at the finishing line.

The protest was upheld and Another Briteone is relegated from 4th to 5th immediately behind Tehora Mistletoe the horse lapped on.
