Following the running of race 10, the ?Chippie McCullum of Riversdale Mobile Pace? junior horseman M White, the driver of LUNAR SANDS, was charged with a breach of Rule 869 (4



Following the running of race 10, the ?Chippie McCullum of Riversdale Mobile Pace? junior horseman M White, the driver of LUNAR SANDS, was charged with a breach of Rule 869 (4) . It was alleged that Mr White drove his horse in a manner likely to cause interference when he jostled STRAWBS CLASSIE GUY driven by P C Ferguson for approximately 100m, the result being that Mr Ferguson's horse broke in this incident. This occurring some 900m from the finish.

Mr White admitted the breach.

At the commencement of the hearing the Chairman asked Mr White, being that he was a junior driver, if he required assistance or representation however he stated that he was comfortable representing himself.

PENALTY.

--

Prior to receiving submissions on penalty Mr Escott had the incident demonstrated by way of the films of the race. These showed that at about the 900m mark Mr White attempting to move STRAWBS CLASSIE GUY wider on the track. This being from a 3 wide to a 4 wide position.

Mr Escott when making his submissions presented Mr White's record which showed no previous breaches of this rule.

Mr Escott contended that the matter was best dealt with by way of a fine.

Mr White when addressing the committee acknowledged Mr Escott's recommendation and concurred that he had a preference to be fined as opposed to being suspended.

--

In determining the appropriate penalty the committee is of the view that this matter is best dealt with by way of the imposition of a modest fine.

--

In Mr White credit is his admission of the breach together with his good record, however weighed against this is the fact that the jostling was of some duration and this was very little justification other than the desire not to be caught by a tiring runner.

--

However after balancing all the considerations the committee finds that the penalty in this case shall be fine of $250.00
