Following the running of race number 5 the Stipendiary Stewards lodged an information against Mrs Tomlinson alleging a breach of Rule 869 (2) (a) in that she used her whip in an excessive manner

DECISION & REASON
--Following the running of race number 5 the Stipendiary Stewards lodged an information against Mrs Tomlinson alleging a breach of Rule 869 (2) (a) in that she used her whip in an excessive manner in the run home on her horse Midnight Invasion.
----At the outset of the hearing it was noted that the breach was admitted and Mrs Tomlinson confirmed that.
----The Stipendiary Stewards showed the video of the run down the straight and indicated that they believed Mrs Tomlinson hit her horse at least 23 times. Mrs Tomlinson, after viewing the video, confirmed that it was at least that number.

The Stipendiary Stewards noted that Mrs Tomlinson had had a charge under the rule on 7th April 2006 at which time she was fined $200.00. The Stipendiary Stewards sought a suspension of 2 to 3 days.
Mrs Tomlinson accepted that a suspension was appropriate on this occasion.
----The Committee formally finds the charge proven and suspends Mrs Tomlinson's horseman's licence until the completion of racing on 26th December 2006 (an effective 2 day suspension).
