Decision: An information instigating a protest was lodged by Stipendiary Steward N Goodwin alleging that COLLEGE QUEST or its rider placed second by the Judge interfered with the chances of Secret Magic placed fourth by the Judge.

An information instigating a protest was lodged by Stipendiary Steward N Goodwin alleging that COLLEGE QUEST or its rider placed second by the Judge interfered with the chances of SECRET MAGIC placed fourth by the Judge.  The interference occurred in the final stages.

When questioned by Mr Goodwin, Mr Walker confirmed he was running second and COLLEGE QUEST has moved out into the line of SECRET MAGIC over the final stages of the race.

Mr Goodwin explained and demonstrated with the video films, COLLEGE QUEST ridden by S Fieldes racing adjacent to the running rail has shifted out into the line of SECRET MAGIC (M Walker) over the final stages of the race.

Mr R Burgeson confirmed Mr Walker’s evidence.

Mr W Marshment conceded that his horse (COLLEGE QUEST) moved out but felt his horse was always going to run second and the horse on the outside was going to run third.

Mr Fieldes confirmed that contact was made with SECRET MAGIC, but when his horse moved out he tried to straighten but it all happened too quickly.

Mr N Goodwin stated that it was clear COLLEGE QUEST had shifted out into the line of SECRET MAGIC and M Walker was at the time a clear third and his chances of finishing in a higher placing had been affected.

Decision

--

The committee have considered all evidence and video films.  In reaching their decision the committee must decide whether the interference had affected the chances of SECRET MAGIC finishing in a better place, given the margin of a half-length.  Taking into account the severity of the interference and that contact was made, we are in no doubt that SECRET MAGIC’s chances were severely affected.  Because of COLLEGE QUEST’s continual outward movement over 5-7 strides, in our opinion it has cost SECRET MAGIC a minimum of two lengths at a vital stage of the race.  The protest is upheld and final placing’s are 4, 7, 8, 1.

Decision
