DECISION OF JUDICIAL COMMITTEE

Information No. 0831 alleges a breach of Rule 528(1) by John Boyack and the breach has been admitted.

--

Racecourse Inspector Mr BF McKenzie confirmed the defendant had been drug tested at the Matamata Racecourse, during track-work, on Thursday the 8 June 2006.

--

A sample of urine supplied by the defendant was sent to the ESR for testing. Upon analysis it was found that sample ID No.346306 for John Boyack had tested positive to cannabis.

--

Mr McKenzie advised that Mr Boyack acknowledged his use of cannabis.

--

Mr Boyack is a regular track rider at Matamata, and also currently is registered with NZTR as an owner/trainer although he is not training any horses. He does not have any previous penalty record with NZTR.

--

Mr McKenzie submitted that as a licensed person a penalty of $500 should be imposed plus NZTR costs of $200.

--

Taking into account that Mr Boyack, although he has added responsibility as a licensed person, he had only raced one horse in the last five years,and that he does not have any previous penalties the Committee imposed a fine of $400, plus costs of $200 for NZTR, and $100 for the JCA.
