DECISION OF JUDICIAL COMMITTEE
--_____________________________
----
Information No.7022 has been laid by Racecourse Inspector Mr RP Bevege, and the charge reads as follows –
----
“THAT on the 26th day of April 2008, at the Trentham Racecourse at the race meeting conducted by the Wellington Racing Club, being a rider who, having been requested by a Racecourse Inspector to supply a sample of her urine which was found upon analysis, to contain the diuretic Frusemide, committed a breach of Rule 528(1) of the New Zealand Rules of Racing, AND THAT you are thereby liable to the penalty or penalties which may be imposed upon you pursuant to Rule 1003(1) of the said Rules.”
----
Miss Bishop was asked if she understood the Rule which she confirmed and also confirmed she admitted the charge.
----
The summary of facts was read by Mr Bevege and the ESR report was produced as Exhibit 1.
----
Summary of Facts:
----
Miss Bishop agreed with the summary of facts and had no comment. A letter from Miss Bishop was tabled and shown as Exhibit 2.
----
Mr Georgetti was asked to comment and informed the committee he was disappointed in Miss Bishop’s actions. He was her employer and believed she had a future as a race rider.
----
Mr Bevege told the committee that random testing of jockeys is now undertaken on a more regular basis. He asked for a monetary fine of $500 (at the lower end of the scale) because this was her first offence and that she had co-operated totally with the authorities.
----
Decision and Reason:
----
Miss Bishop. In coming to our decision to fine you for this offence, we have taken into account your admittance of the breach and your co-operation with the officials. We remind you again that there is no place for diuretic drugs in racing and were surprised at the ease that you were able to obtain the diuretic drugs and your comments that – “I think they were a high dose pill”. Your employer Mr Georgetti was obviously disappointed in your actions and was unaware you had resorted to taking these pills. This committee fines you the sum of $500.
----
Because this charge is being heard on a race day, between races, no costs are sought.
