Decision:

Following Race 5, a breach of Rule 638 (1) (d) was alleged in that Jockey H Kasim permitted his mount STRONTIUM NINETY to shift inward near the 1600 metres dictating MONTINA DIVA (S Spratt) inwards causing crowding to PINNAFERO (N Harris) and KAWATIRI (C Ormsby) who was checked.

The breach of the Rule was admitted.

The film of the incident was shown and commented on by both parties and as the charge was admitted the Committee then addressed the question of penalty.

Stipendiary Steward Mr M Williamson told the Committee that this was Mr Kasim’s first charge under this Rule and the first time he had appeared before the stewards.  He had not been riding long and up to today had 58 rides.  He did feel, however, that the incident was in the medium range as three horses were affected and one in particular, KAWATIRI, checked.  He felt that the incident would be best handled by way of a suspension.

Trainer S Cameron, on  Kasim’s behalf, confirmed that he did cross too early and caused tightening but he believed jockey N Harris was having trouble with his mount and contributed to the incident.

DECISION AND REASON

--

In coming to our decision to impose a period of disqualification for this incident we have taken into account Jockey Kasim’s guilty plea,  the fact that this is his first offence under this Rule, and his request through his representative Mr Cameron, which was agreed to by the stewards, that the period of suspension begin after the completion of racing at Counties 14 October.

--

Mr Kasim is therefore suspended from race riding from the completion of racing on 14 October until the completion of racing 22 October 2009 (four days).
