Appearing:  Informant – Mr J Oatham
                     Defendant – Miss J Morris

DECISION & REASON:
Following race one an information was filed pursuant to Rule 638(1)(d).  The informant, Mr Oatham, alleged that Miss Morris, rider of SNAGGLEPUSS, allowed her mount to shift outwards near the 100 metres causing a check to A LA VOTRE (J McDonald).

--

Miss Morris pleaded guilty to the charge, and was represented by trainer Mr L Somervell.

--

Mr Williamson demonstrated the video films which clearly showed Miss Morris riding SNAGGLEPUSS move out approximately 1 – 1½ horse widths with 100 metres to run.  This outward movement caused J McDonald to take hold of his mount A LA VOTRE and ease off the heels of SNAGGLEPUSS.

--

Miss Morris said her mount was under pressure and racing greenly.  However, she said she should have straightened sooner.

--

Mr Somervell said Miss Morris had over 100 rides without a charge.

--

PENALTY SUBMISSIONS:
Mr Oatham produced Miss Morris’ record which showed two suspensions in the last 12 months –

--

21 March 2009 – four days
16 August 2009 – four days

--

He said this was a good record, and in mitigation there was some greenness displayed by both horses.  However, Miss Morris had continued riding forward without attempting to straighten her mount.  He submitted this offence was at the lower to middle end of the scale.

--

Miss Morris when asked said she had commitments up to and including 21 January 2010.

--

PENALTY:
The Committee carefully considered all evidence and submissions.  Mitigating factors considered were Miss Morris’ very good record, and her guilty plea.  However, these factors have to be balanced against the loss of momentum suffered by A LA VOTRE at a vital stage of the race.

--

Taking all the above factors into account we impose a suspension on Miss Morris from riding in races which is to start after racing on 21 January and conclude after racing on 27 January 2010 (four days).
