RACEDAY JUDICIAL REPORT

--

Following Race 1, an Information was filed by rider Mrs T Thornton under rule 632 which requested a ruling as to whether CLAIR DE VINE was denied a fair start.

--

Present at the hearing were the official starter Mr T Harrison and Mrs T Thornton, rider of CLAIR DE VINE.

--

Mr Oatham demonstrated the incident by showing the head on view of the films in slow motion.  Mrs Thornton said her mount was unsettled in the barrier and became fractious just as the barriers opened which resulted in her being dislodged from her mount.  Mrs Thornton said she called out to the starter but it was too late.

--

Mr Harrison said that he was aware that CLAIR DE VINE had previous barrier issues.  He noticed the horse reared just as the gates opened but conceded he did not hear Mrs Thornton call out.

--

Mr Oatham said it was noticeable that CLAIR DE VINE was fractious but believed it was through the horse’s own volition.

--

The Committee was left in no doubt that CLAIR DE VINE had caused the rider to be dislodged just after the start by its own accord.  We do not believe there was any failure of the starting stalls.

--

Accordingly we order that CLAIR DE VINE BE declared a starter.
