This is an adjourned inquiry arising from the Auckland Racing Club meeting on 13.12.09. An information was lodged pursuant to Rule 638(1)(d) by the informant, Mr A Coles. He alleged that in race 7, Mr J R Collett, rider of BEIJING BOY, permitted his mount to shift outwards in the final straight. In doing so he was not sufficiently clear causing interference to DEVERRA (J McDonald) and BROADWAY MISS (A Ng).

This is an adjourned inquiry arising from the Auckland Racing Club meeting on 13.12.09. An information was lodged pursuant to Rule 638(1)(d) by the informant, Mr A Coles. He alleged that in race 7, Mr J R Collett, rider of BEIJING BOY, permitted his mount to shift outwards in the final straight. In doing so he was not sufficiently clear causing interference to DEVERRA (J McDonald) and BROADWAY MISS (A Ng).
Mr Collett pleaded guilty to the charge. The Committee noted that Mr Collett’s employer, Mr R Collett, had seen the film and supported the guilty plea. He agreed that Mr J R Collett could represent himself.
--Mr Williamson demonstrated the video films which clearly showed at a point soon after entering the home straight, BEIJING BOY begin to move out. This was a gradual movement which carried on for some time. However, it was clear on the film that BEIJING BOY was not the required distance clear of DEVERRA when moving out.
--Mr J R Collett had nothing to add.
--PENALTY SUBMISSIONS:
Mr Coles told the Committee this was Mr Collett’s sixth charge in the last 12 months. He said Mr Collett was compiling a record for moving out when not clear, something he has to bear in mind. However, he submitted this was at the lower end of carelessness on Mr Collett’s part.
Mr Collett said he had commitments up to and including 26 December 2009.
--PENALTY:
The Committee carefully considered all evidence and submissions before imposing an appropriate penalty. The only mitigating factor is Mr Collett’s guilty plea. Aggravating factors are Mr Collett’s record which is only fair, and the checks to two horses caused by Mr Collett’s outward movement. However, we agree this carelessness was at the low end. Accordingly after taking all the above factors into account we impose a suspension on Mr Collett from riding in races which starts after racing on 26 December and concludes after racing on 31 December 2009 (four days).
