Following the running of Race No. 4 an information was lodged by the Stipendiary Stewards instigating a charge against N P Williamson (Silent Night) pursuant to Rule 869 [3][b] (careless driving).

DECISION & REASON
--Following the running of Race No. 4 an information was lodged by the Stipendiary Stewards instigating a charge against N P Williamson (Silent Night) pursuant to Rule 869 [3][b] (careless driving). The information stated that Mr Williamson attempted to shift The Mercenary (M P Jones) out when he was not entitled to and as a result both Mr Williamson's horse, Silent Night, and The Mercenary broke.
----At the outset of the hearing Mr Williamson who was assisted by Mr B M Orange confirmed that the breach was admitted. The charge is accordingly found proven.
----The Stipendiary Stewards showed the video evidence of the actions of Mr Williamson which clearly showed Mr Williamson attempting to move out when the opportunity did not exist.
----With regard to penalty Mr Ydgren advised the Committee that this was the first occasion that Mr Williamson had been before a Judicial Committee. He submitted that it was his view that the horse The Mercenary lost any chance it may have had in the race as a result of the incident. The Stipendiary Steward submitted that the appropriate penalty either was a fine in the vicinity of $50 or two days suspension. Mr Orange, on behalf of Mr Williamson, advised the Committee that Mr Williamson asked that the matter be dealt with by fine only and that he was in a position to pay the fine.
----The Committee, after considering the submissions in respect of penalty, imposes a fine of $300.00. The matters taken into account: aggravating feature, the loss of any chance either horse had as a result of the incident while the mitigating features were the early guilty plea and the advice by the Stipendiary Stewards that this was the first occasion Mr Williamson had appeared before a Judicial Committee.
