Following the running of Race 3, the Rose Dakin & The Late Coral Graham F&M Mbl Pace, Stipendiary Steward Mr N. G. McIntyre filed an Information against Graduation Horseman Mr R. J. Austin alleging a breach of Rule 869(3)(b).  It was alleged that Mr Austin, the driver of “Cue” (3), drove carelessly shortly after the start when attempting to shift down on the track.

DECISION AND REASONS:

Following the running of Race 3, the Rose Dakin & The Late Coral Graham F&M Mbl Pace, Stipendiary Steward Mr N. G. McIntyre filed an Information against Graduation Horseman Mr R. J. Austin alleging a breach of Rule 869(3)(b).  It was alleged that Mr Austin, the driver of “Cue” (3), drove carelessly shortly after the start when attempting to shift down on the track.

Mr Austin had indicated on the Information that this breach of the Rules was admitted, and also that he did not wish to attend the hearing.

--

Mr McIntyre used video coverage to illustrate this incident, which resulted in “Shamrock Lass” (12) being interfered with, and having its chance in the race severely affected.  When spoken to about this matter Mr Austin was extremely remorseful.

--

In relation to penalty, Mr McIntyre advised that Mr Austin had no previous convictions, and that a fine of between $250-00 and $350-00 would be appropriate in this case.  However Mr Austin has only one horse in training, and he had asked for a suspension instead of a fine.

--

In this case a suspension until after 21 March 2010 was recommended.

--

We took into account all the circumstances of this matter and were satisfied that the penalty recommended was appropriate.  Accordingly Mr Austin’s Graduation Horseman’s licence was suspended from after the completion of racing on 19 February 2010, until after the completion of racing on 21 March 2010.
