Following the running of race 8 an information was lodged by the Stipendiary Stewards under Rule 871 (1) (d) alleging that Mr Johnson the rider of Pingaling allowed his mount to shift ground when not clear causing Bracewell (T M Mosely) to run out of room and clip the heels of Rapaura Road and as a result fell.

DECISION & REASON
--Following the running of race 8 an information was lodged by the Stipendiary Stewards under Rule 871 (1) (d) alleging that Mr Johnson the rider of Pingaling allowed his mount to shift ground when not clear causing Bracewell (T M Mosely) to run out of room and clip the heels of Rapaura Road and as a result fell.
----At the outset of the hearing Mr Johnson confirmed he understood the charge and that the breach was not admitted.
----The rule reads:
------"(1) Every rider commits a breach of these rules who in the opinion of the Judicial Committee is guilty of riding what was:

------Mr Ching said the Stipendiary Stewards held the view that Mr Johnson had shifted out on his mount Pingaling forcing Bracewell out and on to the heels of Rapaura Road.
----Mr Mosely said that he was the rider of Bracewell in race 8 and that he had been following Island Peak ridden by J. Bullard. He said that just prior to the falling of his horse, his horse was moved outwards by the horse on its inside Pingaling and as a result he clipped the heels of the horse Rapaura Road which was to the front and outside of him causing his horse to fall and lose all chance. In response to a question from Mr Ching he confirmed that the movement was from the inside horse and as far as he was aware there was no movement from any other horse apart from his own, which was a result of the outward movement of Pingaling.
----Mr McLaughlin, Stipendiary Stewart, said that he was stationed in the tower at the top of the straight and that he observed Mr Johnson's mount Pingaling move out in the run home and as result of that movement Bracewell clipped the heels of Rapaura Road causing Bracewell to fall.
----Mr McLaughlin demonstrated the evidence with the assistance of the video tapes and asked the other committee to note the position of each of the horses involved and the movement outwards by Pingaling. He said that the video evidence clearly showed Pingaling in a position with a gap in front of it then Pingaling moved outwards and forcing Bracewell out and on to the heels of Rapaura Road and as a result Bracewell fell.
----Mr Johnson in his evidence said just prior the incident his horse may have moved out slightly but he contended that there was contributing movement from other horses and that the falling of Pingaling was not necessarily as a result of the movement out of Pingaling He also suggested that there may have been side on movement from the outside of Pingaling. Mr Johnston was unable to show that movement with assistance of the video.
----Decision & Penalty
----Just prior to the falling of Bracewell it is clear from the video evidence and the evidence of Mr McLaughlin and Mr Mosely the only movement was from Mr Johnson's mount Pingaling. Mr Johnson's horse had been racing in position where there was a gap for it to come through, however, the horse moved out forcing Bracewell on to the heels of Rapaura Road which prior to the incident had been in front and outside of Bracewell and Bracewell fell. Mr Johnson said that there was movement from the inside and outside of Pingaling although he did accept that his horse had moved out.
----The Committee finds as a matter of fact that:

- The movement was from Pingaling and as a result Bracewell clipped heels with Rapaura Road and as a result Bracewell fell. ------
- No other horse or jockey contributed to the falling of Bracewell. --

In respect of penalty Mr Ching said that Mr Johnson had three had suspensions in the last twelve months:
--25 February 2007 3 days
--28 October 2006 4 days
--30 September 2006 2 days plus $1,000 fine
----In respect of the current charge Mr Ching submitted that a suspension was appropriate and should be in the range of 3-6 days.
----The Committee finds that the aggravating feature was the consequence of the movement out and the fall of the favourite Bracewell which lost all chance.
----The mitigating factors are the relatively good riding record of Mr Johnson over the last 12 months, bearing in mind that he rides at most available meetings both in the North Island and in the South Island.
----The Committee in addressing the question of penalty takes into account the aggravating and mitigating factors and finds that the interference on this occasion, although at the low end of the scale, did result in a horse losing all chance, however, believes that the appropriate penalty should be three (3) days.
--Before imposing the penalty Mr Johnson was asked whether or not he sought a deferment in the implementation of the penalty but after a short discussion said that he his wish was for the suspension to commence immediately following racing on 25 August 2007 as he wished to be available to ride on Saturday 1 September 2007. Accordingly, Mr Johnson's licence to ride was suspended from completion of racing on 25 August 2007 until completion of racing on 31 August 2007 (an effective 3 days).
