Following the running of race 7 and information was lodged by the Stipendiary Stewards instigating a protest against Fantasy in Blue (14) placed 3rd by the Judge.

DECISION & REASON
--Following the running of race 7 and information was lodged by the Stipendiary Stewards instigating a protest against Fantasy in Blue (14) placed 3rd by the Judge. The information alleged that on the home turn Fantasy in Blue or its driver interfered with Announcement causing that horse to break and lose all chance.
----The hearing was delayed for a short time to ascertain whether or not the connections of Fantasy in Blue would be attending the hearing.
----The relevant rule reads:

- The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which: ----
- may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or ----
- may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, - --

immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.
----At the commencement of the hearing Mr K Barron indicated that he was representing the interests of Fantasy in Blue and would also be assisting junior driver, Ms Jenkins.
----Mr Walkinshaw said that with approximately 450 metres to run he had moved out four wide with Ms Jenkin’s horse Fantasy in Blue on his inside and that Fantasy in Blue came out sharply and contacted his horse causing it to break and lose all chance.
----Mrs Williams, Stipendiary Steward, said that Ms Jenkins moved off the three line position with Mr Walkinshaw (Announcement) on her outside moving forward with Mr Walkinshaw pulling on the right rein. As a result of the movement out by Fantasy in Blue there was contact and Announcement broke and lost all chance. It was her view that the culpability lay with Ms Jenkins.
----Mr Barron said that it his interpretation of the race that at that point as Announcement moved forward Fantasy in Blue did come out and may have reacted to the whip action of Mr Reynolds on Great Divide ahead and inside Fantasy in Blue. He demonstrated his view of the incident with the assistance of the video evidence.
----Just shortly prior to this point Mr Cations, the trainer of Fantasy in Blue, entered the enquiry room. He was asked for his view of the matter and he said that he thought Announcement was a victim of its own undoing as it had its head round.
----In summing up Mr N. McIntyre said that although Announcement was hanging it was making a forward move and was entitled to do so. He said it was the Stipendiary Stewards clear view that the breaking of Announcement was due to the sudden outward movement of Fantasy in Blue.
----The Committee, after giving consideration to all of the statements made at the hearing and viewing the video evidence, finds as a matter of fact:

- That Announcement had commenced a run four wide with Fantasy in Blue slightly ahead but on its inside ----
- That Fantasy in Blue moved out but in doing so moved wider than would normally be expected and as a result made contact with Announcement who broke and lost all chance ----
- That the movement out by Fantasy in Blue was greater than was necessary --

The Committee finds that there was intereference to Announcement caused by Fantasy in Blue and has to consider whether or not a relegation should take place. After taking into account the matters referred to above the Committee is of the view the proper outcome of the hearing is to relegate Fantasy in Blue to 11th place, that is immediately behind Announcement.
