Following the running of Race 7, Christchurch Casino 144th New Zealand Cup (Group II), an information was filed by Chief Stipendiary Steward, Mr C J George, against Licensed Jockey, Mr N G Harris, alleging that Mr Harris, as the rider of EVERSWINDELL in the Race, "made a celebratory gesture prior to the winning post".

Following the running of Race 7, Christchurch Casino 144th New Zealand Cup (Group II), an information was filed by Chief Stipendiary Steward, Mr C J George, against Licensed Jockey, Mr N G Harris, alleging that Mr Harris, as the rider of EVERSWINDELL in the Race, "made a celebratory gesture prior to the winning post".
----Mr Harris was present at the hearing of the information and admitted the breach. The breach was found proved.
----Mr George showed the closing stages of the Race on video replays. He pointed out Mr Harris’ celebratory gesture which he made "clearly prior to the winning post". Mr George conceded that it took place only "a stride and a half" from the finishing line. He submitted that Mr Harris was well aware of the Rule. He said that numerous riders had been charged with a breach of the Rule. Mr George submitted that an appropriate penalty would be a fine between $250 and $500. It was Mr Harris’ first breach of the Rule but it was, Mr George pointed out, the New Zealand Cup.
----Mr Harris readily admitted the breach of the Rule but asked for leniency. He had not breached the Rule previously. The gesture was close to the finishing line and Mr Harris said that he was surprised, when told after the Race, that it had occurred prior to the finishing line.
----The Committee, in determining penalty, took into the account the following matters:

- Mr Harris’ frank admission of the breach; ----
- The fact that the gesture was made in close proximity to the finishing line; and ----
- The fact that Mr Harris had not previously breached the Rule. --
