Following Race 9, the "Starcraft NZ Stakes", Group 1, 2000 metres, information No.6543 was laid. The charge alleges a breach of Rule 871(1)(d) ? Careless Riding ? namely "that Lisa Allpress the rider of SHIKOBA, No.12, allowed her mount to shift outwards when not sufficiently clear

DECISION & REASONS:

--

Following Race 9, the "Starcraft NZ Stakes", Group 1, 2000 metres, information No.6543 was laid. The charge alleges a breach of Rule 871(1)(d) ? Careless Riding ? namely "that Lisa Allpress the rider of SHIKOBA, No.12, allowed her mount to shift outwards when not sufficiently clear of PENITENTIARY, No.4, ridden by jockey Michael Rodd, causing interference to that runner who was consequently forced outwards on to PRETORIUS, No.3, ridden by C Tremayne who was forced outwards on to WILLY SMITH, No.8, ridden by Mark Hills."

Jockey Lisa Allpress denied the charge.

After hearing evidence from Jockey Michael Rodd rider of PENITENTIARY, No.4, who said SHIKOBA ridden by Lisa Allpress early in the home straight moved out "abruptly" when not clear of his mount causing interference.

Stipendiary Steward Mr A Coles, gave evidence. He said that SHIKOBA ridden by L Allpress was just behind BAZELLE, she angled her mount out sharply for a run two horse widths when not sufficiently clear of PENITENTIARY ridden by Michael Rodd. He demonstrated the incident that happened early in the home straight on the head-on/side-on/rear films. He demonstrated Mrs Allpress angling out when not sufficiently clear causing interference to PENITENTIARY, No.4, and a subsequent chain reaction to other outside runners, namely, PRETORIUS, No.3, ridden by Miss C Tremayne, WILLY SMITH, No.8, ridden by Mr M Hills.

The Committee heard evidence from Mrs Allpress, rider of SHIKOBA. She said that she accepted making contact as alleged, but denied her riding in the circumstances was careless riding. She said her horse, SHIKOBA, a 3-year-old filly and favourite, was travelling very well and there was a gap. She SHIKOBA saw the gap and was travelling that well she just let her head go. She came out two horse widths and made an effort to straighten as soon as she could because she heard Michael Rodd calling. Mrs Allpress maintained that she had done everything she could have in the circumstances.

The Committee preferred the evidence of Mr Coles and Mr Rodd, and accepted Mr Coles' evidence and interpretation of the incident.

--

Conclusion:

--

The Committee found that Mrs L Allpress, rider of SHIKOBA, No.12, allowed her mount to shift outwards when not sufficiently clear of Mr Rodd's mount PENITENTIARY, causing interference and consequential interference to PRETORIUS and WILLY SMITH.

--

Accordingly, the Committee found the charge proven to the required standard (Rule 871(1)(d)).

--

Penalty:

--

The Committee carefully considered all submissions on penalty from Mr McCutcheon and Mrs Allpress. The Committee accepted Mr McCutcheon's submission that a suspension should be imposed. Mr McCutcheon sought a three-week suspension and reminded the Committee that this was a Group One race and that three horses had suffered interference.

In considering penalty the Committee noted, rule 1122(2), which provides inter alia, "the judicial committee may have regard to such matters as they consider appropriate including:

  1. The status of the race
  2. --
  3. The stake payable in respect of the race
  4. --
  5. Any consequential affects upon any person or horse as a result of the breach of the rule."

This was a Group One stakes race.

This was a race with substantial monetary stakes.

--

Three horses suffered consequential interference, namely, PENITENTIARY(No.4), WILLY SMITH (No.8), PRETORIUS (No.3).

--

The Committee said their starting point was a three-week suspension, however, taking into account Mrs Allpress' excellent riding record and her evidence, the suspension was reduced to two weeks.

Mrs Allpress had her jockey's licence suspended from the conclusion of racing on 15 March 2006 up to and including racing on the 29 March 2006 (two weeks).
