Following Race 9 an Information was filed pursuant to Rule 869 (2).  The Informant Mr R Sanders alleged that Ms S Hale presented the horse OUR BIG GUY to race in Race 9 without a lead bag.

Following Race 9 an Information was filed pursuant to Rule 869 (2).  The Informant Mr R Sanders alleged that Ms S Hale presented the horse OUR BIG GUY to race in Race 9 without a lead bag.  Ms Hale admitted the breach.  Mr Sanders explained to the Committee that Assistant Stipendiary Steward Mr W Robinson detected the horse OUR BIG GUY did not have a lead Bag in the parade ring before the race.  He phoned the information through.  Ms Hale was informed and the horse was resaddled.

Ms Hale explained she had placed the lead bag on a blue rug on the rail when saddling and simply omitted to put it on.  She said she had never made this mistake before.  She said she herself realized her mistake soon after it was discovered and was confident the horse would not have raced without it.

PENALTY SUBMISSIONS

Mr Sanders said it was fortunate the mistake was discovered as the horse was second favourite.  He submitted a fine of $400 - $600 would be appropriate.

Ms Hale said she did pick the problem up albeit after Mr Robinson.  She did not believe it should be taken into account that the horse was second favourite.

PENALTY

--

The Committee has taken into account all the above factors particularly that this was Ms Hale’s first offence under this rule and her early guilty plea.

Accordingly we impose a fine of $500

--
