DECISION AND REASON

Following Race 9 an Information was filed pursuant to Rule 871 (1) (d) when it was alleged by Mr George, that Mr Collins allowed his mount PASTA POST to shift in approximately 200 metres after the start, when not the required distance clear of SALPERTON (M. Du Plessis) who received a sharp check.
--Mr Collins admitted the charge.
--Mr Oatham demonstrated the video films and showed that at approximately the 200 metre mark, PASTA POST shift in and take the line of SALPERTON ridden by Mr Du Plessis. Mr Oatham stated Mr Collins was not the required distance clear and Mr Du Plessis received quite a severe check. Horses on the inside of SALPERTON were also tightened as a result of Mr Collins' actions.
--Mr Oatham also pointed out that Mr Peard, riding FANTASTIC DANCER and racing just ahead of PASTA POST did not contribute to the interference as there was always a gap between the two horses.
--Mr Collins said in his statement that the racing was tight at the time and this was only his mount's third start. He said he had ducked in approximately 2 horse widths and he pulled off straight away.
--PENALTY
--The Committee invited submissions from Mr George and Mr Collins on the question of penalty.
--Mr George produced Mr Collins' record, which was a good one, showing Mr Collins' last suspension being a 3 day one in October 2006. However, he asked the Committee to take into account the severe check suffered by Mr Du Plessis on SALPERTON. He said the Committee should also consider the status of the race, being a Group I $700,000 race. He believed an appropriate penalty should be one of at least 5 days.
--Mr Collins had little to say in regard to penalty when asked. He said he does ride in the Central Districts, but not in the South Island.

In reaching a correct and fair decision the Committee has to consider the following :
--- The degree of carelessness in the offence itself.
--- The provisions of Rule 1122 (2) namely :
--- --
- The status of the race. --
- The $700,000 stake. --
- Any consequential effects upon any person or horse as a result of a breach of the Rule.
We also have taken into account Mr Collins' early guilty plea and his good record for 06/07 season.
--After due consideration and taking all the above into account, we believe that normally a 7 day suspension would be the correct penalty. However, because of Mr Collins' guilty plea, his candid admission and his good record, we have therefore afforded a day's discount in terms of penalty. Accordingly, Mr Collins is suspended from race riding from the conclusion of racing on Wednesday 7th March 2007 until after the conclusion of racing on the 22nd March 2007 (6 days).
