DECISION AND REASON:
--An information lodged by Stipendiary Steward Mr Muirhead against Junior Horseman Mr A White, driver of REUBEN HALL, placed second, alleging a breach of Rule 869(3)(b) ? Careless Driving ? in that REUBEN HALL struck the sulky wheel of KAFELNIKOV, driven by Ms K Jordan shortly after the start of the race, causing the tyre to come adrift, resulting in KAFELNIKOV having to be pulled up.
--Mr White admitted the breach and was present at the hearing, assisted by senior horseman Mr P Butcher.
--Mr Muirhead demonstrated the incident by use of the video film. REUBEN HALL drew barrier two on the second line, following out KAFELNIKOV. Shortly after the start, horses on the front line drawn outside KAFELNIKOV moved across inwards and caused KAFELNIKOV to be eased slightly. Shortly after this REUBEN HALL struck the sulky wheel of KAFELNIKOV. The tyre came adrift and KAFELNIKOV had to be pulled up.
--Penalty:
--Mr Muirhead said Mr White had no relevant breaches of the rules recorded against him and that there were mitigating factors. He suggested a fine of $200.
--Mr Butcher said a fine of $200 was excessive. He suggested $100. He said Mr White was a junior horseman, it was his first offence (of this kind), he was unlucky, and it was irrelevant that the tyre had come adrift.
--When asked for a response, Mr Muirhead said he was not concerned if the fine was less than $200.
--In fixing penalty the committee took into account the following:

- The submissions of Mr Butcher --
- Mr White's good driving record --
- The offending was at the lower end of the scale, particularly taking into account the mitigating factor of KAFELNIKOV being eased.
