Decision: Under Rule 866 (1) (c) an information was lodged by Stipendiary Steward Mr S Ching, after Race 10, the Macaulay Motors and Pub Charity 1850, alleging that D G Bradley failed to ride his mount, LAUTENSCHLAGER, to the finishing line.

Under Rule 866 (1) (c) an information was lodged by Stipendiary Steward Mr S Ching, after Race 10, the Macaulay Motors and Pub Charity 1850, alleging that D G Bradley failed to ride his mount, LAUTENSCHLAGER, to the finishing line.  Mr Bradley originally did not admit the breach, but on viewing the video evidence changed his plea, admitting the breach.

Stipendiary Steward Mr Ching used the side-on and head-on video clips of the incident, highlighting to the Committee the point where Mr Bradley stopped riding his horse.

Stipendiary Steward Mr Davidson supported Mr Ching stating that Mr Bradley eased down his horse LAUTENSCHLAGER shortly before the winning post when holding fifth place, and was beaten into that fifth place by TUTUSAFORE, ridden by Renee Fraser, who finished at a very fast rate from well back in the field and on the outer of LAUTENSCHLAGER.  Neither Mr Ching nor Mr Davidson believed Mr Bradley’s actions were deliberate or of ill intent.  Mr Bradley was extremely remorseful, on reflection of his actions, and believed that the earlier interference caused by his horse in the home straight may have affected his judgement.

In fixing penalty the Committee took the following factors into account :

--

 

--

1.         Mr Bradley’s outstanding career riding record (twenty two years in the industry with no breaches under this Rule).

--

 

--

2.         Mr Bradley’s guilty plea and his obvious remorse surrounding his actions.

--

 

--

3.         Mr Bradley’s professionalism, integrity and conduct throughout both hearings he had appeared at throughout the day.

--

 

--

4.         The stake on the fifth placed horse, in this case $175.00.

--

 

--

5.         The recommendation from the Stipendiary Steward Mr S Ching that a fine between $500.00 and $1,000.00 would be appropriate.

--

--

The Committee believed that the breach was at the lower end of the scale, and there were mitigating circumstances that may have affected Mr Bradley’s lack of judgement in this instance.

--

Mr Bradley was fined the sum of $500.00.

--
