Mr Knowles, stipendiary steward, protested against the 4th placing of VATUVEI in race 1 on the ground that it was in its incorrect gait in excess of 50 metres during the final 200 metres. The information alleged a breach of R 870(3), in that the horse failed to promptly regain its proper gait.
--Placings after the determination of the earlier protest were 12, 6, 5, 9, 10, 1.
--Mr Allison, stipendiary steward, demonstrated on the video that VATUVEI broke in the run home and continued in a gallop until the winning post, a distance in excess of 200 metres. Mr Jones did not dispute this.
--We are satisfied that VATUVEI galloped for a distance of approximately 200 metres at the conclusion of the race. This is a significant distance and is in breach of the breaking horses regulations and R 870(3). We exercise our discretion to disqualify pursuant to R 1003(2).
--Amended placings are: 12, 6, 5, 10, 1.
