Decision:
Following the running of Race 5, a protest was lodged by Mr SC Ching, the Stipendiary Steward, pursuant to Rule 876(1), in which he alleged that "Tiffany" ridden by R. Norvall (placed 3rd), caused interference to "Angeca" ridden by K. Akehurst (placed 4th), and thereby affected the chances of "Angeca" finishing in a better position.
| -- DECISION AND REASON --Summary of Facts --Following the running of Race 5, a protest was lodged by Mr SC Ching, the Stipendiary Steward, pursuant to Rule 876(1), in which he alleged that "Tiffany" ridden by R. Norvall (placed 3rd), caused interference to "Angeca" ridden by K. Akehurst (placed 4th), and thereby affected the chances of "Angeca" finishing in a better position. --The interference was alleged to have occurred in the concluding stages of the race. --The margin between 3rd and 4th was half a length. --Mr Ching showed the hearing the incident on the head on, side on and 600 metre video films. --Mr Ching alleged that Mr Norvall's mount rolled in on "Angeca", coming into contact briefly, when not his horse's length and another length clear. Mr Ching said there was a gap for Ms Akehurst to improve into, but was prevented by so doing as Mr Norvall's mount closed the gap that was available. --Ms Akehurst's mount then, following the incident, had to change its line when improving well, only to be beaten into 4th place by half a length. --Mr Norvall said that his horse was "lugging in" and that he had to stop using his whip twice in order to straighten it. --Mr Frye, the trainer of "Tiffany", said that he was of the opinion that "Angeca" was reluctant to go into the gap when it was available because of the whipping action of the rider of the horse immediately on the inside of "Angeca". --Ms Akehurst said that her horse was racing well, that Mr Norvall's mount bumped her briefly and closed the gap which had been available to her. In response to a question from Mr Ching, Ms Akehurst confirmed that Mr Norvall's mount was not its length and another length clear when the interference occurred. --Decision --We do not accept Mr Norvall's account of the incident. All of the films shown to the inquiry demonstrated quite clearly the incident complained of. Ms Akehurst was denied the chance of taking the gap that was available. We do not accept that her mount was reluctant to go into that gap because of the whip action of the rider on her inside. Mr Norvall's horse rolled onto her horse when not sufficiently clear. Thus we are satisfied that interference occurred. --We now turn to consider whether or not "Angeca's" chances were affected. After the incident, Ms Akehurst quite skillfully moved her mount onto a new line and then improved well, but was beaten for 3rd place. Therefore, we conclude that "Angeca's" chances were affected. --Having found that interference occurred and that "Angeca's" chances were affected, we now turn to consider whether we should exercise our discretion to change the placings of the horses involved. --We are in no doubt that e should exercise our discretion in favour of "Angeca". We take the view that "Angeca" would have finished in a better position if it had not been for the interference. --The placings will now be: --1st 6 "Classic Tycoon" --2nd 8 "Perci Beau" --3rd 7 "Angeca" --4th 10 "Tiffany" --5th 3 "Warrior Prince" --6th 1 "Global Charm" ---- -- --
