--| ---- An Information was laid following the running of Race 3 by Stipendiary Steward Mr T Taumanu against Junior Driver Mr H CULLEN alleging that he drove ASABELLA carelessly causing interference to Crystal Desert with approximately 300 metres to run ----Mr Cullen denied the charge and was present for the hearing and supported by Driver Mr B MANGOS ----It was agreed by both parties that relevant evidence adduced at the earlier protest hearing be accepted ----Video recordings of the incident we replayed for the benefit of Mr MANGOS ----Cross examined by Mr Mangos Mr Noakes reaffirmed that his horse was travelling and following another horse with Mr Blanchards colours when Mr Cullen moved around his outside. At this point Mr Cullen had moved inwards after pulling his earplugs, tightening Crystal Desert striking his front legs and causing her to break up and lose all chance in the race. ----Mr Mangos contended that Crystal Desert had broken 30 plus metres after the point at which interference was alleged to have occurred intimating that she had broken free of any interference caused by Asabella ----Mr Noakes was adamant that Asabella had been solely responsible for the interference and this this had been the direct cause of he drive breaking up. ----Mr Taumanu submitted that a horse could travel some way off balance before breaking. ----It was accepted that the Video tapes did not assist greatly in resolving the outcome of the hearing. ----DECISION ----The evidence given by Stipendiary Steward Mr J MUIRHEAD who had a clear view of the incident from his positon on the home turn supported the course of events as recounted by Junior driver Mr NOAKES. ----It is apparent Junior Driver Mr H CULLEN has moved in on Crystal Desert shortly after pulling the earplugs on Asabella coming into contact and this interference caused Crystal Desert to break up and lose all chance. ----The matters raised by Mr Mangos in his spirited support of Mr Cullen did not raise sufficient doubt in the Stipendiary Stewards interpretation of the events and the charge was established. ----Following submissions on penalty and taking into account his driving record, commitments and the degree of carelessness Mr CULLEN received one days suspension concluding after the end of racing on the 31st March 2005 ------ -- -- -- -- -- --
