An information lodged by Stipendiary Steward Mr J M Muirhead against Mr M Purdon, driver of GALLEONS ASSASSIN, alleging a breach of Rule 869 (3) (b) ? Careless Driving

An information lodged by Stipendiary Steward Mr J M Muirhead against Mr M Purdon, driver of GALLEONS ASSASSIN, alleging a breach of Rule 869 (3) (b) ? Careless Driving ? in that he caused interference to SMART SEEKER driven by Mr A Butt about 250m after the start. Mr Purdon admitted the breach and was present at the hearing. Mr Muirhead demonstrated the incident by use of the video film. About 250m after the start Mr Purdon moved his horse from the three wide to the two wide position and in doing so cramped up SMART SEEKER which broke and was forced to race further back in the field. Mr Purdon said the incident happened close to the corner and his horse naturally moved inwards and he tried to correct it but it was too late and his sulky brushed the front leg of SMART SEEKER.

PENALTY :

Mr Muirhead suggested a suspension in the region 2- 6 days. He said Mr Purdon had a clear driving record and had been very frank with the Stipendiary Stewards. Mr Purdon agreed with a suggestion by Mr Muirhead that the suspension be up to and including the 18th of May 2007. In fixing penalty the Committee took into account the following matters.

  5. The submissions of Mr Muirhead.

  7. The explanation of Mr Purdon and his acceptance of Mr Muirhead's submissions.

In balancing those matters, the Committee suspended Mr Purdon's horseman's licence until the conclusion of racing on the 18th of May 2007 which is effectively four days, two of those days being Premier race Days at which Mr Purdon would have been driving several of the horses he trains.
