Under Rule 213 (1) (j) : Following the running of Race 7, Horrelville Station Pace, an information requesting a ruling was filed by Stipendiary Steward, Mr N G McIntyre, on the following matter:

“Driver K Hadfield (WOKEUPTHISMORNING) was denied a fair start in Race 7”.

Rule 213 (3) (j) provides as follows:

--

(1)     A Stipendiary Steward at any time may scratch from a race . . . any horse on all or any of the following grounds:-

--

            (a)     if a horse was denied a fair start and such occurrence materially prejudiced the chances of that horse.

--

A video replay of the start of the Race was shown.

--

Mr Hadfield said that when the starter, Mr Lamb, let the horses go he said his horse (which had drawn barrier 1 at the 2000 metres standing start) was “quite a few lengths back”. The horse had been standing there for some time because other runners had been playing up. His horse was not even standing on the track when the starter let the field go, he said. The horse was being held by a starter’s assistant, Mr Ryan, whom he yelled at to let the horse go. In response to a question from Mr McIntyre, Mr Hadfield acknowledged that his horse had backed out as a result, he said, of a cloud of dust caused by the wind. The horse had been made to stand for too long at the start.

Mr McIntyre referred to Rule 857 (6) which sets out the reasons for which a starter sound a  recall in a standing start race. Those reasons are:

--

(a)     interference prior to the barrier strand(s) being released;

--

(b)     a barrier strand fails to release or its incorrect release interferes with a horse;

--

(c)     a Starter’s Assistant impedes the progress of a horse.

--

Mr McIntyre submitted that the barrier manners of a horse did not provide grounds for a false start. The whole field had been standing for some time. The horse drawn the inside barrier had to stand for longer than the rest of the field in every standing start race, he said.

Mr Ryan said that he never left the horse all the time it was standing at the barrier. He conceded that there had been problems at the start of the Race. He said that he could have gone for his head when the horse backed out but said that, if the starter had let the field go, he would have been in the way. Mr Ryan said that the manners of the mare had let her down.

The Committee was satisfied that WOKEUPTHSMORNING was not denied a fair start in the Race. The failure to leave the mark on terms with the rest of the field was caused by the mare’s own unruly manners – it was slow away of its own accord. If the cause of a horse being slow away is of its own making then it cannot be found to have been denied a fair start. The cause has to be something beyond the control of the horse for it to be found to have been denied a fair start. Although starters take every care to ensure a good start, generally a horse cannot be said to have been denied a fair start if it is the author of its own misfortune.

Accordingly, the ruling of the Committee was that WOKEUPTHISMORNING was not denied a fair start in the Race and was declared to be a starter.
