Miss K. Myers permitted her mount ‘Tobouggie Nights’ to shift inwards near the winning post on the first occasion dictating ‘Golden Jewel’ (J. Walsh) inwards on to ‘Seeker’ (L. Allpress) who was checked. Rule 871 (1)(D).

--The charge being admitted, Stipendiary Steward N. Goodwin showed the available films head, side and rear view, pointing out to the committee the alleged incident. Miss K. Myers having admitted the charge did feel there were a number of factors which contributed to the incident. She felt that she did pull off but believed Jockey J. Walsh was unaware of Miss Allpress’ mounts position and may have contributed to the incident.
--Mr Goodwin informed the committee that this was Miss Myers first charge under this rule since a 3 week suspension at Hastings on the 04/08/08. He felt the incident was in the mid to high range as a horse clipped heels and the movement inward was significant. He felt that Miss Myers did take evasive action but in hindsight it may have been a little late. She does ride throughout NZ and has an excellent record.
--Miss Myers confirmed she did ride at venues throughout New Zealand and asked the committee to consider the fact that she has a tentative very good book of rides at the Awapuni races on Saturday the 13th of June.

Decision and Reason:
Miss Myers, in coming to our decision to impose a period of suspension for your breach of this rule, we have taken into account firstly your guilty plea and secondly your very good race riding record. Mr. Goodwin did inform us that he believed the incident was one that ranged in the mid to high range, to which we concur. We have also taken into account that you do ride throughout New Zealand on a regular basis.
--This committee suspends you from race riding from the completion of racing on Saturday the 6th of June until the completion of racing on Friday the 12th of June – 4 days.
