CHARGES:
--At the conclusion of race 3 the Gore Plumbing Services Maiden an information 7493 (was lodged by Stipendiary Steward Mr M Davidson) under rule 638(1)(d) alleging that C W Johnson the rider of Ballyrina allowed his mount to shift outwards and check Mangaroa Prince (A.Mundy) in the final 50metres of the race.

The rule reads a rider shall not ride a horse in a manner which the Judicial Committee considers to be careless

Mr Johnson admitted the breach.

FACTS/SUBMISSIONS
--Stipendiary Steward Mr Davidson showed the committee several video clips of the alleged incident highlighting the outward movement of Ballyrina when not sufficiently clear causing Mangaroa Prince to be checked.

Mr Johnson made no comment.

DECISION:
--The committee was satisfied a breach of the rule had occurred. Clearly Mr Johnson had not taken any corrective action allowing his horse to move outwards when not sufficiently clear.

SUBMISSION(s) ON PENALTY:
--Mr Davidson stated that Mr Johnson had received five suspensions under this rule over the past twelve months. These occurred at the following meetings
--16/1 Greymouth 3 days
--17/4 Wellington 4 days
--8/5 Riccarton 5 days
--20/6 Timaru 4 days

Mr Davidson said he believed the interference was minimal and was from the mid to the low end of the scale in carelessness.

Mr Davidson also stated that Mr Johnson was a national rider, riding throughout the country successfully and on this occasion he had admitted the breach.

Mr Johnson wished the committee to take into consideration the seven day rule as he had firm riding engagements up to an including racing on Sunday the 17th October 2010

PENALTY:
--Mr Johnson was suspended for four National riding days. In fixing penalty the committee considered the breach of the rule to be at the lower end of the scale and also took into account Mr Johnson’s very busy riding schedule and the early admittance of the breach.

Mr Johnson’s suspension is to commence from the conclusion of racing on Sunday 17th October 2010 until the conclusion of racing on Saturday 23rd October 2010.
----
Mr Johnson was however reminded of his professional obligations and that any further breaches of this rule in the near future will result in far more serious consequences than the penalty on this occasion.
