Following race 8 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J P Oatham, that L G Innes rider of COOL TALK committed a breach of that rule
| -- Following race 8 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J P Oatham, that L G Innes rider of COOL TALK committed a breach of that rule when "at the 200 metres from the finish COOL TALK being ridden by L Innes when being ridden out moved in dictating LA STRADA (A Calder) inwards who received tightening and lost ground". ----Mr Innes pleaded guilty at an early stage. The only issue for determination is penalty. After hearing submissions on penalty from Mr Oatham and Mr L Innes, and taking into account the following ? --Your plea of guilty --That a relegation happened due to interference --Your record is fair --Your explanation ----We have determined a suspension is appropriate. Our starting point is a minimum of 5 days, but because of your guilty plea we reduce the period to 4 days commencing from the conclusion of racing on Sunday, 12 December, up to and including 22 December 2004. |
