RACEDAY JUDICIAL COMMITTEE DECISIONS

--

FRIDAY 26TH FEBRUARY 2010

--

JCA PANEL:    B. Rowe – Chairman,  B. Scott

--

RACE NO: 3  INFORMATION NO: 13661  RULE NO:  869(4) and (8)

--

This is an information instigating a protest filed by Stipendiary Steward Mr J. Muirhead on behalf of CLEAN CUT driven by Mr K. Barron placed 7th by the Judge against GRACE WAY driven by Mr T. Herlihy placed 4th by the Judge on the grounds of interference shortly after the start.

--

Mr A. Grierson and Mr Herlihy represented the connections of GRACE WAY.

--

Mr Muirhead said that shortly after the start GRACE WAY moved inwards and dictated the line of MANHATTAN CRUZER driven by Mr D. Butcher which in turn moved inwards and dictated the line of WOT THE OWL driven by Mr P. Young and that horse in turn moved inwards and made contact with CLEAN CUT which broke and lost several lengths.

--

Evidence was heard from Mr Barron, Mr Young and Mr Butcher.

--

At the conclusion of that evidence Mr Muirhead sought and was granted leave to withdraw the protest.  The evidence disclosed a number of factors which could have contributed to the interference suffered by CLEAN CUT.

--

The Committee was firmly of the view that it was quite proper for this protest to have been filed.
