Jockey J McDonald was charged under Rule 330 (1) (A) in that he broke a riding engagement to ride the horse Shotgun Start in Race 9.

The rule was read and Mr McDonald confirmed he understood the rule.

Stipendiary Steward Goodwin informed the committee that Mr McDonald requested to the stewards that he be released from his ride in Race 9 as he had a plane to catch at 6.30 and that with the last race to be run at 5pm he was concerned that having to be at the airport half an hour before he would not make the flight.  He had commitments to ride track on Tuesday morning.

Contact was made with Mr Haigh, the trainer Shotgun Start, and he, to put it mildly, was very disappointed.  There were other experienced jockeys available, Mr Goodwin added.

Mr McDonald was asked if he was not aware of the time-frame when the ride was accepted.  He told the committee his manager had accepted the ride.

Submissions on penalty:
Mr Goodwin confirmed that the time frame could be tight – it was a public holiday in Wellington and traffic at around 5pm is usually very heavy.  There had been occasions in the past where riding engagements had been broken so it was not creating a precedent.  He asked for a fine in the vicinity of $100-$200.

Mr McDonald had no comment.

Decision on Penalty:
Mr McDonald, in coming to our decision to impose a monetary penalty we have taken into account your explanation for the request and your admittance of the breach.

--

We are concerned that a jockey of your ability accepted the ride on Shotgun Start and then requested you be released for reasons that should have been examined by yourself and your manager prior to acceptance.

--

The connections must be disappointed and hopefully at some stage during the day you will apologise to Mr Haigh.  We have researched other breaches of the rule in coming to our decision but however, cannot find a similar breach in the last 12 months.

--

We therefore have turned to the JCA Guide for Judicial Committees where we find the maximum fine suggested is $500.

--

The only mitigating circumstance that we can concur with is the Anniversary Day traffic which could make it difficult to reach the airport in time for your flight.

--

This however should have been taken into account by you and your manager.

--

We have noted the suggested penalty from the Stipendiary Stewards.  However, we believe the figure of $100-$200 is too light.  As a leading jockey you have a responsibility to the owners, trainers and the betting public and in this case we believe that responsibility has been breached and we believe you have demonstrated a lack of professionalism.

--

The penalty we intend to impose, hopefully, will send a clear signal to you and your fellow jockeys.

--

You are fined the sum of $350.00.
