Following the running of Race 1, the Alabama Road Vet Clinic Trot, an Information was filed by Stipendiary Steward Mr N. G. McIntyre against licensed trainers Mr P. F. and Mr M. J. O’Brien alleging a breach of Rule 864(2)(d). It was alleged that the removable earplugs had not been affixed to “Gregan Galleon” (11) so as not to malfunction.

Following the running of Race 1, the Alabama Road Vet Clinic Trot, an Information was filed by Stipendiary Steward Mr N. G. McIntyre against licensed trainers Mr P. F. and Mr M. J. O’Brien alleging a breach of Rule 864(2)(d). It was alleged that the removable earplugs had not been affixed to “Gregan Galleon” (11) so as not to malfunction.
--Mr M. J. O’Brien had indicated on the Information that this breach of the Rules was admitted, and that he did not wish to be present at the hearing. Mr McIntyre gave evidence and used video coverage to illustrate this incident. A fine of $100-00 was recommended. We were satisfied that as the breach was admitted, and as there were no previous convictions, that a fine of $100-00 was appropriate. Accordingly Mr P. F. and Mr M. J. O’Brien were fined the sum of $100-00.
