Hearing of information number 7772 filed under Rule 871(1)(d) by Mr Cameron George alleging careless riding by Mr P Taylor, Licensed Jockey
Following the running of Sky City Auckland Cup, Mr P Taylor was charged with careless riding pursuant to Rule 871(1)(d) of the Rules of Racing. Mr Taylor admitted the breach of the Rules and the charge is therefore deemed to be proved.
----Assistant Stipendiary Steward, Mr W Robinson, demonstrated the incident on video from two perspectives, from the rear on camera and the side on camera. Mr Taylor was racing in behind "Philamor" (J Collett) one off the rails. He then improved outwards when not sufficiently clear of "Pentane" (M Walker) who was buffeted and checked. This incident occurred near the 700 metres.
----In response, Mr Taylor felt that "Pentane" was racing on his outside quarters with another horse racing on the outside quarters of it, and that as a consequence of Mr Taylor's outward movement that "Pentane" rather became the "meat in the sandwich" and that this was contributed to by the horse racing on the rear quarters of "Pentane". He believed that he had moved only half a horse width but that in so doing "Pentane" came in to contact with his hind quarters and with a consequential angling out of his mount from the contact that "Pentane" made with his horse. He felt that it was "Pentane" that made the incident look worse because of the fact that it moved him "sideways".
----In reply, Mr George commented that really Mr Taylor had no room to improve and that he should have stayed in behind "Philamor".
----PENALTY DECISION
----Mr George placed emphasis on the fact that this incident occurred in a Group 1 race for a stake of $700,000 and that a suspension was called for. He felt that the minimum suspension should be five days. He did, however, tell us that Mr Taylor has a good riding record and has not been suspended from race riding since March 2005.
----In response, Mr Taylor observed that he has a lot of rides and that the incident did take place "a long way from home". He felt that there were other horses which contributed to the incident. He did not oppose the imposition of a period of suspension but neither did he submit that the matter could be dealt with by way of fine.
----In considering the penalty, we have to take into account a number of factors including the provisions of Rule 1122(2) of the Rules of Racing. Those matters include:

- The stake involved ----
- The effect on another horse or horses ----
- The degree of carelessness --

After carefully considering all matters, we are in no doubt that a period of suspension is called for. It is important to be consistent in terms of other suspensions that are imposed for infringements in races of the same or similar status. Therefore, in all of the circumstances, we believe that the starting point for a suspension is six days.
----However, we have given Mr Taylor credit for his early guilty plea and for his good record and accordingly, we set the period of suspension at five days.
----Mr Taylor is therefore suspended from the conclusion of racing on Saturday 10 March until the conclusion of racing on Thursday 22 March. In setting that period of suspension, we observe that Mr Taylor confirmed to the hearing that he was not anticipating riding in the South Island and, therefore, this period of suspension represents a five day suspension for him.
