Decision: Following race one, an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr A R Coles, that J Gillies, rider of NO GOING BACK, committed a breach of that Rule when he permitted his mount to shift outwards near the 800 metres when not sufficiently clear

Following race one, an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr A R Coles, that J Gillies, rider of NO GOING BACK, committed a breach of that Rule when he permitted his mount to shift outwards near the 800 metres when not sufficiently clear dictating JAILHOUSE (I Lupton) outwards causing crowding to LA VELISTA (J Hunt)  and THE SHOE (C Parish).

Mr Gillies did not admit the charge.

Mr J Oatham demonstrated the videos.  He showed the field as it left the back straight and progressed round the turn.  Mr Gillies could be seen on his mount NO GOING BACK on the rails and trailing ISLAND STORM.  Following Mr Gillies was a group of horses comprising JAILHOUSE, LA VELISTA and THE SHOE.  They made progress and with some outward movement Mr Lupton could be seen to move on to NO GOING BACK’S hind quarters.  Mr Gillies had also made progress in reducing the gap behind ISLAND STORM.  As Mr Gillies got near to ISLAND STORM he moved his mount out to go round the horse without having regard for the position of JAILHOUSE.  Consequently Mr Lupton had to take evasive action which resulted in the tightening to the horses racing outside of Mr Lupton.

Mr Oatham estimated Mr Gillies’ outward movement to be 1 – 1 ½ horse widths.

Mr Lupton, when questioned, said that at the 800 metres he got a little check as he angled off the rails.  He did admit that if he had waited a little he would have been able to take the inside gap created when Mr Gillies moved out.

Mr Gillies, in defence, showed where he felt he was always racing at least one width off the fence.  He felt he was almost a victim of circumstances as he pulled out to avoid the heels of ISLAND STORM.  He said he was not aware of any horse on his outside.

After reviewing the films and the evidence the Committee preferred Mr Coles’ evidence and consequently find Mr Gillies guilty of moving out when not sufficiently clear of JAILHOUSE and causing the resultant interference.

Mr Coles gave Mr Gillies excellent record in his submission on penalty.  He asked for a suspension of 4 days.

--

Mr Gillies had no submissions other than advising his riding engagements.

--

PENALTY:

--

After due consideration the Committee suspend Mr Gillies from riding beginning after the conclusion of racing on 9 July until the conclusion of racing on 17 July 2008 (4 days).
