--Mr Gillies was present at the hearing and was represented by horseman G Martin.
--Mr Gillies admitted the breach.
--A film of the alleged incident was shown and clearly showed Mr Gillies using the whip excessively in the concluding stages of the race.
--In submissions as to the penalty Mr Taumanu told the Chairman that Mr Gillies had told him he was not in a position to pay a fine so he (Mr Taumanu) recommended a term of suspension.
--Mr Gillies told the Chariman he was committed to driving at Counties on Tuesday 6th.
--When arriving at a penalty the Chairman took into account Mr Gillies admission of the breach, however he felt as Mr Gillies was not in a position to pay a fine a suspension should be imposed.
--Mr Gillies was suspended from the conclusion of Racing on the 6th March until the conclusion of racing on March 16th, in effect two days.
