| -- DECISION AND REASONS: --Following the running of Race 4 Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 871(1)(d) alleging Jockey M. Cameron (Rich Image) rode carelessly. --The information reads as follows. --"I the abovenamed informant allege that the abovenamed Defendant ------committed a breach of Rule 871(1)(d) in that he allowed his mount "Rich Image" to shift inwards when not sufficiently clear after approx. 300m making firm contact with "Hapuku Hero" (T. R. Moseley) which in turn took the line of "Blue Cavalier" (J. D. Laking) causing it to clip a heel." --Rule 871(1)(d) reads as follows. --"(1) Every rider commits a breach of these Rules who in the opinion of the --Judicial Committee is guilty of riding which was: --(d) Careless'." --Present at the hearing were Mr M. Cameron, an Apprentice Jockey, and Mr Allan Sharrock, licensed trainer and employer of the defendant, who was present to assist the defendant. The defendant had indicated on the information that he admitted the breach of this rule, and he confirmed this at the hearing. --Mr Ching illustrated this incident by means of video coverage, and said that although the defendant could be seen to pull his mount off Mr Moseley's horse it was too late by then. ----PENALTY: In relation to penalty Mr Ching advised the Committee that the defendant had a good riding record, although there was a previous conviction for careless riding on 29 March this year. Mr Ching said he believed the breach was in the "middle" range of seriousness and that a suspension was warranted. --The defendant said that he had been riding for about 2? years and that he had only the one conviction for careless riding. --DECISION ON PENALTY: In determining the appropriate penalty we have taken into account the following matters. --
On the other hand we have also taken into account that this was a Premier --Meeting and that the defendant was suspended for two days in March this year. --Taking all the above matter into account the defendant is suspended until after the completion of racing on 4 September 2004, which is effectively three riding days. --It should be explained that the defendant had already been suspended on 11 August 2004 until after the completion of racing on 26 August 2004. --
