Jockey K A Smith was charged under Rule 871 (1) (D) that as the rider of FRANKIE THAT in Race 8 he allowed his mount to shift inward when not clear of VOLAISHA (H Tinsley) forcing that runner in onto REPUBLICAN STAR (K Collins) who was also tightened.

Jockey K A Smith was charged under Rule 871 (1) (D) that as the rider of FRANKIE THAT in Race 8 he allowed his mount to shift inward when not clear of VOLAISHA (H Tinsley) forcing that runner in onto REPUBLICAN STAR (K Collins) who was also tightened.

Jockey Smith admitted the charge.

The committee viewed the film of the incident and heard comment from stipendiary steward Goodwin and K A Smith.

Stipendiary steward L N McCutcheon informed the committee that K A Smith was last charged under this rule on 18 November 2004. He believed it was a breach of the rule at the top end of the scale. FRANKIE THAT shifted inwards sharply. Jockey Smith was looking inwards and should of and could of come off before he did. H Tinsley, rider of VOLAISHA, was forced onto REPUBLICAN STAR, causing severe tightening. He asked for a period of suspension.

Jockey K A Smith asked that his guilty plea be taken into account. He felt that the tightening of REPUBLICAN STAR could be attributed to a general tightening by a number of horses. He intended to ride in the Rotorua Cup and asked for a penalty that incorporated a fine and suspension.

DECISION ON PENALTY

--

The committee was of the opinion that this was a serious breach of the rule. The film shown and commented on by both the stipendiary steward and the defendant clearly showed the inward movement and the tightening that affected at least two other horses.

In the committee's opinion Jockey Smith angled his horse across sharply and did not take any action until after the tightening occurred. There was ample time to have taken action before the tightening occurred. The committee acknowledged that Jockey Smith admitted the breach of the rule. It also took into account that he was last charged under this rule in 2004.

--

The committee felt that this was a breach of Rule 871 (1) (d) at the top end of the scale and it was unable to accommodate Mr Smith's desire to ride in the Rotorua Cup.

Jockey K Smith was suspended from race riding after racing on Saturday 7 May 2005 until the completion of racing on Thursday 26 May 2005. ( Five Central Districts race days).
