An information lodged by Deputy Stipendiary Steward Mr B Van Kan against Mr D Balle, trainer and driver of JAG STAR alleging a breach of Rule 864 (2) (d) in that the removable earhood on the horse did not activate when pulled in the run home.
--Mr Balle admitted the breach and was present at the hearing.
--Mr Van Kan demonstrated the incident by use of the video film. At the entrance to the home straight Mr Balle attempted to activate the removable earhood but it did not release and remained in position.
--PENALTY :
--Mr Van Kan recommended a penalty of $200.00 taking into account that this was a premier meeting. Mr Balle said that the incident didn?t make any difference to the horse's performance and that he thought that the recommended penalty was a little high. He said he must have tied the earhood too tight under the horse's chin.
--In fixing penalty the Committee took into account the following matters :

- The guilty plea. --
- Mr Balle's clear driving record. --
- Mr Van Kan's submissions. --
- Mr Balle's explanations. --
- This was a premier meeting ? stake money for the race $20,000.00
In balancing all of those matters, the Committee imposed a fine of $200.00.
