Decision: Following race 6 an information was filed by Mr J Oatham pursuant to Rule 876(1).  He alleged that MIDDAY HERO (L Satherley) placed first by the Judge interfered with the chances of IMPASSE (M Hills) placed second by the Judge

DECISION & REASON:

Following race 6 an information was filed by Mr J Oatham pursuant to Rule 876(1).  He alleged that MIDDAY HERO (L Satherley) placed first by the Judge interfered with the chances of IMPASSE (M Hills) placed second by the Judge, in the final straight.  The margin between first and second was half a length.

Present at the inquiry were:

L Satherley (jockey MIDDAY HERO)

Trainer Mr C Wood (IMPASSE)

--

M Hills (jockey IMPASSE).

--

Mr M Williamson, Stipendiary Steward, demonstrated the video films and showed that soon after entering the home straight MIDDAY HERO commenced to move out gradually and on two occasions made contact with IMPASSE with the final bump causing IMPASSE to be put off stride.  He said that at this stage IMPASSE was on level terms with MIDDAY HERO and in his opinion this final bump cost IMPASSE the race.

Mrs Satherley, rider of MIDDAY HERO, said she was always in front after having come from behind IMPASSE.  She said she was always going to win easily and Mr Hills did not have to stop riding.

Mr C Wood, trainer of IMPASSE, said his horse was bumped on several occasions and the final contact cost him all chance of winning.

--

Mr M Hills concurred with Mr Wood and said the contact cost him the race.

--

Mr J Oatham said when asked for his assessment of the incident, said it was clear there was continual outward movement from MIDDAY HERO in the final 200 metres, contact on two occasions with the last contact being quite severe shifting IMPASSE abruptly.  He believed the protest should be upheld.

The Committee is clearly satisfied that IMPASSE did suffer interference in the final 200 metres when MIDDAY HERO moved outwards into IMPASSE’S line and on two occasions made contact.  

--

We are clearly of the opinion that this interference was sufficient to affect the chances of IMPASSE finishing in a better place.  In applying our discretion as to whether we should relegate we have considered the following:

--

 

--

1.            The half length margin at the post.

--

2.            The strong manner in which IMPASSE was finishing.

--

3.            It was clear that IMPASSE was on level terms with MIDDAY HERO at the time of the last bump.

--

Accordingly the protest is upheld and the placings shall now be:
