On the issue of penalty Stipendiary Steward Mr Goodwin advised that Mr Tinsley had been in breach of this rule on 4 occasions since August 2008 and called for a fine of $400-$500.

Mr Tinsley took full responsibility for his failure to make the weight but added nothing further as to penalty.

We believe a fine is appropriate and in setting that we have given Mr Tinsley credit for his frank admission of the matter and his weight management difficulties. However we note with disquiet the frequency of his offending in this regard over recent months and believe a more substantial pecuniary penalty than has previously been imposed is necessary to attempt to instil in Mr Tinsley a deeper sense of responsibility around the obligations he assumes when accepting rides. He is fined $450.
