Decision: -- Rule 869(6) (b)(e)(c): At the conclusion of race 8 The American Ideal @ Woodlands Stud Mobile Pace, a Protest was lodged by driver Mr B Shirley (BEST LEGACY) who finished 13th in the race, alleging that with approximately 1000 metres to run SLY GOLFER (A R Beck) improved on the inside of BEST LEGACY forcing it to race wider on the track. SLY GOLFER was officially placed third by the judge at the conclusion of the race. Rule 869(6) (b)(e)(c): At the conclusion of race 8 The American Ideal @ Woodlands Stud Mobile Pace, a Protest was lodged by driver Mr B Shirley (BEST LEGACY) who finished 13th in the race, alleging that with approximately 1000 metres to run SLY GOLFER (A R Beck) improved on the inside of BEST LEGACY forcing it to race wider on the track. SLY GOLFER was officially placed third by the judge at the conclusion of the race. Mr Shirley used several video clips of the alleged incident to highlight BEST LEGACY's racing position, which he determined was four wide on the track leading up to and beyond the 1000 metre mark. Mr Shirley stated that Mr Beck had pushed out to make his move, and as a result his horse BEST LEGACY raced wider. Mr Shirley was of the opinion that Mr Beck was not entitled to move outwards as BEST LEGACY was already filling the space and he was entitled to do so. Mr Beck refuted Mr Shirley's comments, also highlighting that the video evidence was inconclusive. Mr Beck asked Mr Shirley to point out the 1000 metre mark off the video clip. Stipendiary Steward Mr Allison was then asked to assist and identify the 1000 metre mark, from the marker pegs. Mr Allison stated that it was difficult to do so, and that the video clips were of little assistance in his opinion in this instance to determine the outward movement of Mr Beck and at what precise point it took place. Mr Allison continued by stating that the Stipendiary Stewards did not proceed with a Protest because of the mitigating factors he had previously mentioned. DECISION/REASON: The Protest was dismissed. The panel was satisfied that there was not sufficient evidence to uphold the Protest. The video footage was totally inconclusive in our opinion with regard to the outward movement of Mr Beck and at what point of the race this occurred. There is no doubt that BEST LEGACY was forced over extra ground, however determining at what point was extremely difficult and whether or not a breach of the rule had occurred. A Dennis Chairman
