DECISION AND REASONS:

Following the running of Race 4, Jack Brankin & Rex Shadbolt Memorial Discretionary Handicap Trot, an information instigating a protest was filed by Stipendiary Steward, Mrs K R Williams, against STARWOOD IN ASPEN (T J Grant), placed 3rd by the judge. No details of the alleged breaking were given in the information form.

Mr Grant, part-owner, trainer and driver of STARWOOD IN ASPEN, was present at the hearing of the information and indicated that he represented the connections of the horse.

Mr N R Escott, Chief Stipendiary Steward, showed video replays of the final 200 metres of the Race. He pointed out that, approximately 40-50 metres after the 200 metre mark, STARWOOD IN ASPEN broke from its gait and continued in a gallop for "a good 70-odd metres" and more than maintained its ground and it was only over the latter stages that the horse lost any momentum, Mr Escott alleged. STARWOOD IN ASPEN finished in 3rd placing. The Committee noted that STARWOOD IN ASPEN regained its proper gait just prior to the finishing line.

Mr Grant disputed Mr Escott's estimate of the distance over which STARWOOD IN ASPEN had galloped and submitted that it was about 40 metres. He stated that, turning into the straight, he was following RACEY PRODUCT (the eventual winner) he

had been forced about 3 cart-widths wide by that runner which had made his horse trot unevenly and go off stride. His horse had been trying to sprint home and get around the leader which had drifted out, he said. Mr Grant showed the head-on video replay.

The Committee found that:

  • RACEY PRODUCT did not contribute in any way to the breaking of STARWOOD IN ASPEN and certainly did not interfere with STARWOOD IN ASPEN; and
  • --

    --

  • STARWOOD IN ASPEN had galloped for a distance clearly in excess of 50 metres within the final 200 metres of the Race and had therefore breached Rule 870 (3) in that it failed to promptly regain its proper gait.

Having found those matters, the Committee was required by the Breaking Horses Regulation to either relegate or disqualify STARWOOD IN ASPEN. In the circumstances, the Committee determined that the appropriate course was to disqualify STARWOOD IN ASPEN from the Race and STARWOOD IN ASPEN was disqualified accordingly.
