Mr Allison, stipendiary steward, laid an information after race 9 alleging that contrary to rule 869(2)(a), Mr Swain, driver of BRAHMAN GIRL used the whip excessively in the run home.

--Mr Swain admitted the breach and indicated on the information that he did not wish to be present at the hearing.
As Mr Swain has admitted the breach, we find the charge proved.
--Mr Allison has demonstrated on the video 30 plus strikes of the whip. First there were some 8 strikes before the home turn. These were quite forceful. Then were over 20 strokes in a continuous fashion over approximately the final 175 metres of the race. These were repetitive with the horse being given little respite. We accept, however, that Mr Swain did not remove his hand from the rein when striking the horse on the latter occasion.
--Mr Allison produced Mr Swain’s record which showed no breaches of this rule in the past season and indeed, Mr Allison believed, for a number of seasons.
--Given Mr Swain’s ready admission of the breach and his excellent record, especially as he has a number of drives in a season, we accept Mr Allison’s recommendation that the matter can be dealt with by way of a fine.
--Mr Swain is fined the sum of $250.
