Decision:

At the meeting of Otago Racing Club at Wingatui on 6 November 2007, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Trainer, Mr M W Walker, alleging that Mr Walker, as the trainer of AMAZING SKY, an acceptor for Race 1, Arthur Barnett/Estee Lauder/Air NZ/Orbit Corporate Travel Two-Year-Old, failed to scratch that horse by the required time.

At the meeting of Otago Racing Club at Wingatui on 6 November 2007, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Trainer, Mr M W Walker, alleging that Mr Walker, as the trainer of AMAZING SKY, an acceptor for Race 1, Arthur Barnett/Estee Lauder/Air NZ/Orbit Corporate Travel Two-Year-Old, failed to scratch that horse by the required time.

The information was served on Mr Walker at the meeting of Canterbury Racing at Riccarton Park on 29 February 2008 and was heard on that date. Mr Walker signed the Statement by the Defendant endorsed on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found to be proved.

Mr Ching stated that Mr Walker was not present at the meeting on 6 November 2008 but was in Australia. Mr Ching said that he understood that, due to a misunderstanding, the horse had accepted for the meeting. Mr Ching received a telephone call from the stable foreman of Mr Walker’s Rangiora stable, Mr Clutterbuck, saying that the horse should be scratched as it was not even in Dunedin but was still at home in Rangiora. The manager of the Matamata stable had overlooked scratching the horse prior to the 7.30am scratching deadline.

Mr Ching informed the Committee that Mr Walker had not breached the late scratching Rule within the last 12 months. He recommended a fine of $100.

Mr Walker was fined the sum of $100.
