Rule 861 (1) states “each horse shall as far as is practicable be drawn up before the start upon its proper mark and position by the starter and/or his assistant(s)”.

Mr Muirhead advised that at no time did Mr Courtney request Mr Ferguson to place his horse in the correct unruly position. Mr Courtney also advised that he had not requested Mr Ferguson to take his horse to the unruly position.

Submissions were heard on penalty from both Mr Muirhead and Mr Courtney.

--As the breach of this rule has been admitted by Mr. Courtney and having taken into account Mr Courtney’s good record a fine of $250.00 is imposed in this instance.
